RCLOUDS.ME TERMS OF SERVICE

The Service is available to individuals aged 13 years or older. If you are 13 or older but under the age of majority in your country of residence, you must review this Agreement with your parent or guardian to make sure that you and your parent or guardian understand it.

By accepting this Agreement, you represent that you understand and agree to the foregoing. By creating an RClouds account you are stating that you agree to these terms of service

Use of the Service requires compatible devices, Internet access, and Roccat; may require periodic updates; and may be affected by the performance of these factors. Runecats reserves the right to limit the number of Accounts that may be associated with a device. The latest version of required software is recommended to access the Service and may be required for certain transactions or features. You agree that meeting these requirements, which may change from time to time, is your responsibility.

Backup/Restore
Automatic backup is available for devices, and occurs periodically, when your device is connected to the internet and logged in to your RClouds account. Runecats shall use reasonable skill and due care in providing the Service, but, TO THE GREATEST EXTENT PERMISSIBLE BY APPLICABLE LAW, RUNECATS DOES NOT GUARANTEE OR WARRANT THAT ANY CONTENT YOU MAY STORE OR ACCESS THROUGH THE SERVICE WILL NOT BE SUBJECT TO INADVERTENT DAMAGE, CORRUPTION, LOSS, OR REMOVAL IN ACCORDANCE WITH THE TERMS OF THIS AGREEMENT, AND RUNECATS SHALL NOT BE RESPONSIBLE SHOULD SUCH DAMAGE, CORRUPTION, LOSS, OR REMOVAL OCCUR. It is your responsibility to maintain appropriate alternate backups of your information and data.
You must understand that your data may be hosted and backed up on various servers, including third party servers from various hosts. Runecats is not responsible for data loss on our or third party servers.

Changing the Service 
Runecats reserves the right to modify or terminate the Service (or any part thereof), either temporarily or permanently. Runecats may post on our website and/or will send an email to the email address associated with your Account to provide notice of any material changes to the Service. It is your responsibility to check the website and your email address registered with RClouds for any such notices.
As a registered user of the Service, you may establish an Account. Don’t reveal your Account information to anyone else. You are solely responsible for maintaining the confidentiality and security of your Account and for all activities that occur on or through your Account, and you agree to immediately notify Runecats of any security breach of your Account. You further acknowledge and agree that the Service is designed and intended for personal use on an individual basis and you should not share your Account and/or password details with another individual. Provided we have exercised reasonable skill and due care, Runecats shall not be responsible for any losses arising out of the unauthorized use of your Account resulting from you not following these rules.
In order to use the Service, you must enter your RUNEID/RCLOUDID and password to authenticate your Account. You agree to provide an accurate email for the RUNEID/RCLOUDID.

Access to Your Account and Content 
Runecats reserves the right to take steps Runecats’ believes are reasonably necessary or appropriate to enforce and/or verify compliance with any part of this Agreement. You acknowledge and agree that Runecats may, without liability to you, access, use, preserve and/or disclose your Account information and Content to law enforcement authorities, government officials, and/or a third party, as Runecats’ believes is reasonably necessary or appropriate, if legally required to do so or if we have a good faith belief that such access, use, disclosure, or preservation is reasonably necessary to: (a) comply with legal process or request; (b) enforce this Agreement, including investigation of any potential violation thereof; (c) detect, prevent or otherwise address security, fraud or technical issues; or (d) protect the rights, property or safety of Runecats, its users, a third party, or the public as required or permitted by law.

Termination by Runecats 
Runecats may at any time, under certain circumstances and without prior notice, immediately terminate or suspend all or a portion of your Account and/or access to the Service. Cause for such termination shall include: (a) violations of this Agreement or any other policies or guidelines that are referenced herein and/or posted on the Service; (b) a request by you to cancel or terminate your Account; (c) a request and/or order from law enforcement, a judicial body, or other government agency; (d) where provision of the Service to you is or may become unlawful; (e) unexpected technical or security issues or problems or (f) your participation in fraudulent or illegal activities Any such termination or suspension shall be made by Runecats in its sole discretion and Runecats will not be responsible to you or any third party for any damages that may result or arise out of such termination or suspension of your Account and/or access to the Service. In addition, Runecats may terminate your Account upon prior notice via email to the address associated with your Account if (a) your Account has been inactive for one (2) years; or (b) there is a general discontinuance or material modification to the Service or any part thereof. Any such termination or suspension shall be made by Runecats in its sole discretion and Runecats will not be responsible to you for any damages that may result or arise out of such termination or suspension of your Account and/or access to the Service.

Amendments and Changes to Content 
You understand that in order to provide the Service and make your Content available thereon, Runecats’ may transmit your Content across various public networks, in various media, and modify or change your Content to comply with technical requirements of connecting networks or computers. You agree that the license herein permits Runecats to take any such actions.

Notices 
Runecats may provide you with notices regarding the Service, including changes to this Agreement, by email to your RClouds email address (and/or other alternate email address associated with your Account if provided), by regular mail, or by postings on our website and/or the Service. Runecats have the right to send emails about other products and services, this will come standard with an RClouds account. If you do not wish to recieve these emails you must terminate your RClouds account by contacting contact@runecats.com.

Changes 
Runecats reserves the right at any time to modify this Agreement and to impose new or additional terms or conditions on your use of the Service. If you do not agree with them, you must stop using the Service and contact Runecats Support to retrieve to terminate your account. Your continued use of the Service will be deemed acceptance of such modifications and additional terms and conditions.

GDPR COMPLIANCE

At Runecats we respect your privacy and we promise to:

  • Use your personal information only to provide you with the information you have requested or have agreed to receive.
  • Keep your data safe and secure and process it in a manner that follows your wishes.
  • Only disclose your data to third parties for marketing purposes when you have said it’s OK to do so.

WHAT DATA WE COLLECT

We collect your Full Name, Email and sometimes Phone number on our website contact and enquiry forms. We are the sole owners of the information collected on this site. We only hav
e access to the information you voluntarily give us. We will use your information to respond to you, regarding the reason you contacted us. We will not sell or rent this information to anyone. Although emails will be stored on one of our trusted partners email servers located in the UK.

If you use our RClouds Services we will store your recent Roccat browsing history, bookmarks and browser settings, this is stored as an encrypted plist file we’re unable to see this information. We also store your email for login purposes and occasionally to inform you of important product updates.

If you use our FusedBar aware feature on Roccat or Roccat:Connect certain requests will be sent to RClouds servers and passed onto third parties in order to serve your requests and get the answers you desire. These requests may be sent to Google, Wikipedia, DBpedia, Nutritionix, iTunes, Mashape, Fixer.io, Oxford Dictionaries, Distance24, The Guardian, OpenWeatherMap, ip-api.com, omdbapi.com, Audio Scrobbler, Musix Match, Go Shippo.

For some requests your IP will be sent across to be used to provide a rough location, this is used for certain location based requests such as local business and weather requests. You can opt out of FusedBar Aware in Roccat’s privacy settings. We do not personally store your requests although they may appear in server logs for a temporary amount of time.

WHERE IS YOUR DATA HELD

Your data is held on secure servers operated by Runecats in the UK, and will be stored under the robust security measures. Your data may also be held by some of our trusted partners and suppliers, these include but are not limited to: WPEngine, Unlimited Web Hosting, Google, Microsoft, Amazon, Apple iCloud, Dropbox, Facebook.

DATA SECURITY

When you give your personal data to Runecats we will process that data in accordance with our responsibilities under the Data Protection Act 1998, and the Privacy and Electronic Communications (EC Directive) Regulations 2003 and other relevant legislation.
We will keep your data safe and secure. To prevent unauthorized access, maintain data accuracy and ensure the correct usage of information, we monitor and adjust our physical, electronic and managerial procedures to safeguard and secure your personal data while in our care, or in the care of any outside suppliers with whom we may contract to process your data on our behalf. Any outside suppliers are under strict contractual terms to mirror the security policies that we currently have in place.

WHAT WE DO WITH YOUR DATA

We will process the data you supply in order to provide any service you have requested when you sign up on our website. We will only use your personal data for the purposes you have permitted and we will not share it for marketing purposes outside of Runecats. unless you have given us permission to do so. If this practice changes in the future, we will update this policy to identify the non-agent third parties and include customer opt-out information.

WE USE GOOGLE ADSENSE ADVERTISING ON OUR WEBSITE.

Google, as a third-party vendor, uses cookies to serve ads on our site. Google’s use of the DART cookie enables it to serve ads to our users based on previous visits to our site and other sites on the Internet.
